The investigation of an alleged sexual assault of a patient at Northern Hospital of Surry County by an employee there has led to a misdemeanor charge against a Dobson man.


James Adam Cave, 28, of 394 Cave Road, is accused of one count of sexual battery, according to a spokesman for the Mount Airy Police Department.


The case arose in late June, when a patient described as a male in his early to mid-30s reported being assaulted by a man identified as a “caretaker” at the hospital. The report initially was taken by patrol personnel of the police department and subsequently turned over to the detective unit for investigation.


Police have said the hospital employee was placed on administrative leave pending the outcome of that inquiry, which resulted in the sexual battery charge.


Cave turned himself in to a magistrate earlier this month after it was filed and was released, Capt. Alan Freeman said.


Freeman added Wednesday that insufficient evidence was found to constitute the issuing of any felony violations in the case.


One online definition of sexual battery in North Carolina is “any sexual contact with a victim who is mentally disabled, physically helpless or otherwise incapacitated, where the defendant knows or should know of the victim’s disability.”


Cave is scheduled to appear in Surry District Court on Sept. 4.
